Boing Boing was wrong.
The music industry doesn’t care if you give your downloaded song to someone else - as long as you erase your copy and have no hard media (CD, etc). This is consistent with copyright and fair use laws. The article that Boing Boing linked to didn't have enough information that showed any laws were broken. Bush could have also had his buddy take his iPod, hook it up to a computer, and download into the iPod from the iTunes Music Store legitimately, ...or even bought the CDs for Bush and converted it to MP3 (also a legit method of getting music onto the iPod).
